Section 3: Release for Early Acquisition

Occasionally, early acquisition procedures may need to be used. These procedures are provided by Federal regulations to acquire certain properties before the District is ready to initiate work on the entire project.
The District Engineer determines whether early acquisition parcel(s) are required and advises the ROW Division of the circumstances in the request for a special release.
An LPA may accept right of way donations under provisions for early acquisition of right of way. However, before accepting the donation, the LPA should check with the District to verify that the location of the property to be donated is within the right of way project.
Make any requests for ROW Division approval according to Types of Early Acquisition (for State).
