Additional Release Requirements

No right of way expenses are to be incurred by the District (e. g. , title service contracts or fee appraiser work orders signed by the appraiser) until obtaining a release from the ROW Division.

To obtain release, the project must have environmental clearance. Refer to Environmental Clearance for requirements. When ready to initiate work following environmental clearance and receipt of the executed contractual agreement, advise the ROW Division and request a release. A copy of the release memorandum is forwarded to the Finance Division and serves as their authorization to issue the General Expenditure Authorization. Accompany this request by one copy of the District approved right of way map and the information required by Relocation Program Planning (Volume 3, Relocation Assistance)

All required information must be entered into the right of way information system to obtain release.

In addition to the above, the following requirements apply to an LPA:

  • The fully executed contractual agreement between the State and the LPA establishes the basis for the LPA's acquisition of right of way and the State's basis for reimbursement under the terms of the agreement.
  • Any payments made by the LPA before the date of the State's execution are ineligible (for State) participation.
