For off-system bridge projects where the recipient is not the current owner, a three-party amendment to the previously executed off-system agreement is required. The amendment should be processed through the Bridge Division project manager.
Anchor: #i1001552Historic Bridge Marketing
It is now the policy of the Federal Highway Administration (FHWA) that all historic bridges proposed for demolition must be “marketed” or made available for donation and reuse (see http://www.fhwa.dot.gov//legsregs/title23.pdf). This marketing effort can be adapted to particular bridge. For bridges with little potential for removal and reuse in a different location (i.e., concrete spans, masonry spans, suspension bridges, and bridges with serious structural deficiencies, etc.), the marketing effort can be relatively brief. However, marketing should be initiated as soon as the provisions of Section 4(f) have been met and FHWA has agreed that there is “no feasible and prudent alternative” to the “use” of the historic bridge (that is, its demolition). Contact the BRG project manager and the architectural historian in the Cultural Resources Management Section (CRM) of the Environmental Affairs Division to assess each bridge’s relocation potential and to develop an appropriate marketing plan for each historic bridge proposed for demolition. FHWA and the State Historic Preservation Officer (SHPO) will review and approve the marketing plan.
Anchor: #i1001567Agreement/Amendment for Adaptive Use
The Environmental Affairs Division (ENV), the Bridge Division (BRG) project manager, and the district negotiate a historic bridge agreement/amendment with the local government and/or recipient. Example agreements/amendments are available here and here. Any proposed changes in the agreement/amendment forms must be approved by ENV, BRG, and the Office of General Counsel’s Contract Services Section (CSS). The draft agreement/amendment should be sent to the BRG project manager for review and approval by ENV and BRG before the local government and/or recipient executes the final agreement/amendment. The agreement/amendment should be processed through the Bridge Division (BRG) project manager for final execution by BRG.

Additional environmental analyses and the preliminary engineering process should continue. Any changes from the approved preservation plan during the design stage or construction stage (change orders) must be approved by the Bridge and Environmental Affairs divisions and may require additional consultation with State Historic Preservation Officer (SHPO). No detail design work is to be performed until the environmental process is complete. The final bridge layout and design will not be approved until the environmental process has been completed.
