In unusual situations, GEs may charge rent for occupancy of right of way. For example, on a large right of way project, a GE might, on a hardship basis, purchase the land and improvements in its own name well before the land is needed by the State for construction purposes, and subsequently rent the property before conveying title to the State. In these cases, care must be exercised to assure that the amount of the rent does not exceed the fair rental value of the property on the basis of its being rented to a short-term occupant.
