Once the department determines that a property can be leased, the area needs to be specifically identified by a metes and bounds property description. The property description should include a sketch with the survey calls and should show the relationship and distances of the lease area to the highway and to the lessee's adjacent property. The survey will serve as the basis for the appraisal, as the property description in the lease and, if the lease requires Commission approval, as an exhibit in the minute order. The exhibit must be printed on 8 1/2" X 11" white paper. The survey is to be provided by the lessee, at the lessee’s expense, unless TxDOT already has a property description, as is the case with leasebacks because a survey was obtained for the acquisition. The department should review the survey to ensure its accuracy.
