Procedure

Promptly after receiving of all information submitted by a displacee supporting a review request, the Relocation Assistance Review Committee will afford the applicant full opportunity to be heard. The Committee will review all facts presented, render a prompt written determination on the request (including an explanation of the basis upon which the decision was made), and furnish the applicant a copy of its determination.

In formulating its decisions, the Committee will consider all pertinent justification and other material submitted by the applicant, and all available information needed to ensure a fair and full review. The Committee will have the right to counsel with the Executive Director on any application. The Executive Director will retain the right to make a final ruling alone, or with Transportation Commission counsel if circumstances warrant.

If the full relief requested is not granted, the Committee will advise the applicant of his right to seek judicial review.
