Section 16: Agreement for Access to Texas Department of Transportation Highway Right of Way
On occasion property owners adjacent to the state highway system may need temporary access to state right of way for improvements on their property. This also includes permission to use aerial space above the surface of the right of way.
The permittee shall leave the right of way in the same condition as prior to their usage and give the area office a 72 hour advance notice prior to setting up traffic control. The District will review the plan of action, traffic control, duration of the activity, and description of the adjacent property.
Form 2900 ‘ Agreement for Access to Texas Department of Transportation Highway Right of Way’ can be used for such activity.
