Dumping of materials from TxDOT projects on private property is prohibited as it raises concerns about environmental implications and proper disposal of debris. Utilization of private property as spoil sites shall not be allowed on TxDOT construction projects or routine maintenance.

In cases where no practical options exist, the District Engineer may enter into an agreement with an adjacent property owner to deposit soils; the use must be limited to soil, concrete and other inert materials. Items such as sweeping debris, limbs, brush, stumps or other work-related waste, if not properly disposed of on TxDOT right of way must be taken to landfills authorized to accept the material.
